The deal when you book a night with plusfive, including our house rules.

1. Who we are

These terms apply to every booking of a seat at a plusfive night through plusfive.city between you and Alex Vierdag, trading as plusfive, Am Mühlenbusch 56, 42781 Haan, Germany, phone +49 173 9345039, hello@plusfive.city ("plusfive", "we").

2. What you get

A seat at a small table of people who want to meet new people, at a public bar in the neighborhood shown for your city, on the night and at the start time you booked. A table has four to six people when it is set; on a night we confirmed as happening (section 4) it can also have three. People who cancel after their table is set or do not show up can make it smaller. If more people book, we set several tables, in the same bar or in another bar in the same neighborhood. We put the tables together and choose the bar.

When your table is set, at 12:00 noon local time on the day or, if you book or wait for a table on the day, as soon as it is set, you get the name and address of the bar, the name your table is reserved under, the first names of your table and access to the table chat, on your ticket page and by email. At 19:00 on the day we email you your final table. Day, start time and neighborhood are fixed when you book.

The bar is an independent business. It sells food and drinks under its own terms and prices, and its house rules apply. Food and drinks are not included. We do not host or supervise the night; nobody from plusfive is at the bar.

3. Who can book

Only adults: 18 or older, and 21 or older for nights in the USA. Bars may ask for ID. A booking is for one person, is personal and cannot be transferred.

4. Booking, card hold and when you pay

You book on our website until 19:00 local time on the day of the night. You enter your first name and your payment details on the payment page of our payment provider Stripe, where you can check and correct them before you confirm. The price shown for your city (for example €5, $5 or £5) is the final price per seat, with no extra fees.

When you book, we place a hold for the price on your card. Your card is not charged yet.

5. Your contract with us

By clicking the booking button you make a binding offer. The contract is concluded when the hold on your card succeeds and we confirm your booking by email. It is concluded on the condition that your booking gets a seat at a table (section 4). The contract language is English. We do not keep the contract text available for you; your confirmation email and the PDF attached to it contain the key details, and the current terms are always on this page.

6. Cancelling your seat

You can cancel free of charge until your table is set: until 12:00 noon local time on the day, and after that for as long as you are still waiting for a table. Cancel on your ticket page or by replying to your confirmation email. We then cancel the hold and nothing is charged. Once your table is set there is no refund, also if you do not show up. You can still tell your table on your ticket page that you cannot come; your seat can then be booked by someone else.

7. No statutory right of withdrawal

Your booking is for a leisure activity on a specific date. For such contracts there is no statutory right of withdrawal (§ 312g(2) no. 9 of the German Civil Code and Art. 16(l) of the EU Consumer Rights Directive). The free cancellation until your table is set (section 6) applies instead.

8. If something changes on our side

If a night that has taken place according to section 4 cannot happen for reasons on our side or the bar's side, we refund your seat in full to your original payment method. If a bar becomes unavailable at short notice, we may move your table to another public bar in the same neighborhood and tell you on your ticket page and by email. If we ever have to change the day, the start time or the neighborhood after you booked, you can cancel and get a full refund.

We cannot guarantee that everyone who booked shows up. A table with fewer people than booked is not a reason for a refund.

9. Meeting point and table chat

Your table is reserved at the bar under the name shown on your ticket, for example "plusfive 1". Walk in at the start time and ask the staff for it. There is no live support during the night. To coordinate, use the table chat on your ticket page.

The table chat opens when your table is set, and only your table can read it. Be friendly, keep it about the night, do not post other people's personal data and do not advertise anything. We can delete messages and exclude people from the chat. The chat closes at 06:00 the next morning and is deleted within 48 hours.

10. House rules

In an emergency, call the local emergency number: 112 in Europe, 911 in the USA. If you feel unsafe at the bar, tell the staff. To report anything after the night, reply to your ticket email or write to hello@plusfive.city. We read every report and treat it confidentially.

If someone seriously or repeatedly breaks these rules, we can exclude them from the night with immediate effect and without a refund for that night, and block them from future bookings. Statutory rights remain unaffected.

11. Your responsibility and our liability

You are responsible for your own behaviour, for what you drink, for your belongings and for how you get home. The other guests are not our employees or representatives.

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are only liable if we breach an essential contractual obligation, meaning an obligation that makes the proper performance of the contract possible in the first place and on which you may regularly rely; in that case our liability is limited to the foreseeable damage typical for this kind of contract. Otherwise we are not liable for slight negligence. These limitations also apply to people who act for us. We are not responsible for the services of the bars, which are independent businesses.

12. Final provisions

How we handle your data is explained in our privacy policy. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. German law applies; if you are a consumer and live in another country, you keep the protection of the mandatory consumer law of that country. We may update these terms for future bookings; a booking you have already made keeps the terms that applied when you booked.
